Odour Consultants were commissioned to undertake the odour assessment to provide technical evidence in support of developing a legal case for a Statutory Nuisance, under Part III of the Environmental Protection Act 1990.

Project Outline

Odour Consultants (ODC)  prepared evidence to support the claim for a Statutory Nuisance, believed to be caused by odour originating from an adjacent restaurant and takeaway.

The local authority, South Lakeland District Council, are responsible for taking appropriate action against the takeaway to ensure there is no nuisance of nearby residential properties.

 

Our Role

The key focus of the project was to produce evidence to support the claim, but also to set out clear recommendations for the takeaway to overcome the nuisance, should the claim be successful.

ODC produced the odour evidence to support the claim. The assessment involved onsite odour surveys, comprising a series of sniff-tests to establish the odour conditions in line with good practice guidance. In addition, a risk assessment (using the EMAQ+ guidance) was carried out for the commercial kitchen to further understand the potential risks and what odour abatement and control methods ought be employed by the takeaway.
